Last updated: October 6, 2026

IMPORTANT NOTICE. PLEASE READ BEFORE YOU ORDER

BINDING ARBITRATION AND CLASS ACTION WAIVER FOR U.S. RESIDENTS. If you live in the United States, Section 13 includes a binding arbitration agreement and a waiver of class actions and class arbitration. Except for individual small claims and the other limited exceptions in Section 13.3, disputes between you and us must be resolved through final and binding arbitration on an individual basis. You waive your right to a jury trial and to bring or participate in a class or representative proceeding. You may opt out of the arbitration agreement within 30 days by following the instructions in Section 13.10.

SUBSCRIPTIONS RENEW AUTOMATICALLY UNTIL YOU CANCEL. If you choose a subscription, we will automatically charge your payment method the recurring price shown at checkout, at the interval shown at checkout, until you cancel. You can cancel online at any time, without penalty (see Section 5 for details).

30-DAY MONEY-BACK GUARANTEE ON YOUR FIRST ORDER. The Guarantee is subject to Section 7 and our Refund Policy. Your statutory right of withdrawal, where applicable, is explained in Section 8 and our Refund Policy.

DISCLAIMERS AND LIMITS ON LIABILITY. Section 12 sets out disclaimers and limits on our liability.

1. ABOUT US AND THESE TERMS

1.1. Harmonia Sciences, UAB, a company incorporated in Lithuania (company code 306831905, registered office Perkūnkiemio g. 13-91, LT-12114 Vilnius, Lithuania) (“Harmonia”, “we” or “us”), operates drinkharmonia.com (the “Website”) and sells Harmonia dietary supplements (the “Products”). We are the seller of every order placed on the Website.

1.2. These Terms of Sale (“Terms”) apply to your use of the Website and every purchase you make through it. Our Shipping Policy and Refund Policy, available on the Website, form part of these Terms. Our Privacy Policy, also available on the Website, explains how we handle your personal information but does not form part of these Terms. If information on another page, in an email or in an advertisement conflicts with these Terms or any of these policies, these Terms and the relevant policy take priority to the extent permitted by applicable law.

1.3. These Terms form a legally binding agreement between you and Harmonia. By placing an order, creating an account or otherwise making a purchase through the Website, you confirm that you have read and understood these Terms and agree to be bound by them. At checkout, you must confirm your acceptance before submitting your order. We keep a record of the date and time of your acceptance, the version of the Terms you accepted, your IP address and your order number. If you do not agree to these Terms, please do not use the Website or place an order. You can print or save a copy at any time.

1.4. We may update these Terms by posting a new version with a new “Last updated” date. Updated Terms apply to orders placed after they are posted, and placing an order after an update means you accept them; no separate notice or consent is required. Each order remains governed by the version you accepted when you placed it. Changes to an active subscription are governed by Section 5.7 and changes to the arbitration agreement by Section 13.9.

2. ELIGIBILITY AND PERSONAL USE

2.1. To buy from us, you must be at least 18 years old and legally able to enter into a binding contract with us under applicable law. By placing an order, you confirm that you meet both requirements. You also confirm that you are not located in, or ordinarily resident in, a country or territory subject to comprehensive sanctions, and that you are not subject to sanctions or listed on any sanctions list maintained by the European Union, the United Nations, the United States, the United Kingdom or the Republic of Lithuania.

2.2. Products are sold only for your personal or household use or as a personal, non-commercial gift. By placing an order, you represent that you are not buying for resale, distribution or any other commercial purpose, and that you are not buying on behalf of, or at the request of, anyone who intends to resell the Products. We may limit quantities per order, customer, household, delivery address or payment method.

2.3. You must give us accurate, complete and up-to-date information, keep only one account and use only payment methods you are authorized to use.

3. HEALTH INFORMATION

3.1. U.S. regulatory notice. The following notice applies to relevant statements about Products marketed in the United States:

THESE STATEMENTS HAVE NOT BEEN EVALUATED BY THE FOOD AND DRUG ADMINISTRATION. THIS PRODUCT IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE.

3.2. The Products are dietary supplements, not medicines, and are not a substitute for a varied, balanced diet, a healthy lifestyle or professional medical care. Information, research summaries and reviews on the Website are general information, not medical advice. Read and follow the label and do not exceed the recommended daily dose. Consult your physician before use if you are pregnant or nursing, take medication or other supplements, or have a medical condition or allergy. Keep the Products out of reach of children.

3.3. Results vary and depend on factors such as your health, age, diet, sleep, stress, physical activity, medications and consistent use as directed. We do not guarantee any particular outcome or timeframe, and reviews describe individual experiences that yours may not match. The Money-Back Guarantee is a refund commitment, not a promise of health results.

3.4. If you experience an adverse reaction, stop using the Product and contact your healthcare provider; seek urgent medical attention if the reaction is severe. Please also report it to us at the U.S. address or telephone number shown on the Product label (+1 (717) 833-2723), or at [email protected]. We record reports and submit them to the FDA or another competent authority where the law requires. Reporting a reaction does not affect your rights.

4. ORDERS, PRICES AND PAYMENT

4.1. By placing an order, you offer to purchase the Products under these Terms. The contract is formed when we email you our acceptance. Before acceptance, we may reject all or part of an order if a Product is unavailable, if there is an obvious pricing or description error, if we reasonably suspect fraud or on the grounds in Section 9. If we cancel all or part of an order, we refund everything you paid for the cancelled part.

4.2. You may cancel a one-time purchase or the initial order of a subscription free of charge within 18 hours after placing it by emailing [email protected]. We do not send the order for fulfilment before this period ends. The time we receive your request counts, not the time we reply.

4.3. Prices, discounts and offers are displayed on the Website. Before you submit your order, we show you at checkout the currency and the total payable, including taxes and any other charges. Displayed prices include VAT where required, and we collect sales or use tax where required. Price changes affect future orders only; changes to subscriptions are governed by Section 5.7.

4.4. If a subscription payment fails, we may retry the same amount for up to 30 days, and our payment providers may obtain updated card details through card-network updater services. If payment remains unsuccessful, we pause or cancel the subscription and email you. Retries and updated card details are used only within your existing payment authorization; we never charge a renewal you have cancelled and we honor any valid withdrawal of your authorization.

4.5. If you have a question or concern about a charge or pricing, please contact us so that we can help resolve it promptly. Contacting us about a charge is not a condition of exercising your rights with your bank or card issuer.

5. SUBSCRIPTIONS AND AUTOMATIC RENEWAL

5.1. A subscription renews automatically until you cancel. A one-month supply renews every month, a three-month supply every three months and a six-month supply every six months, each time with the same quantity and at the price disclosed at checkout, subject to Section 5.7. Your first payment is charged when you order and each renewal at the start of the next billing period. There is no minimum number of renewals. A one-time purchase is charged once and does not renew.

5.2. Before you provide your payment information, we show you at checkout that the purchase is a recurring subscription, the initial and recurring amounts, the billing frequency and how to cancel, and you must actively confirm your agreement to automatic renewal before you are charged. We keep a record of your consent. After your order, we email you a confirmation with your plan, payment amounts, billing interval, next payment date and cancellation instructions.

5.3. For one-month, three-month and six-month subscriptions, we email you a reminder at least 24 hours before each renewal payment. Each reminder states the payment date, the amount and how to cancel. We also send any additional notices required by law or the rules of your payment method.

5.4. You can cancel at any time, without a cancellation fee and without speaking to anyone, by emailing [email protected] or in your account settings. Any retention offer is optional: a clear option to complete your cancellation remains available while it is displayed, and you can finish in the same session. We confirm cancellations by email.

5.5. To stop the next payment, you must cancel before the renewal payment is processed. Cancellation stops that renewal and all later renewals. For email requests, the time we receive your email counts.

5.6. A renewal charged before you cancel is shipped as usual and is not covered by the Money-Back Guarantee. You may return its unopened Products under our Refund Policy.

5.7. You may ask to change your delivery address or plan before your next payment. We may change the price of future subscription payments by emailing you the new price, its effective date and cancellation instructions 7 to 30 days before it takes effect, and we obtain your consent where the law requires. We may also update the Products in your plan, for example their formula, flavor or packaging, or replace a discontinued Product with a comparable one at the same or a lower price, by emailing you before your next payment. Any change that increases the quantity you receive or how often you are charged requires your agreement. You may cancel free of charge before any change takes effect.

6. SHIPPING AND DELIVERY

6.1. We ship to the United States and to the European Union and other countries available at checkout. Shipping costs, if any, are shown at checkout before you pay. Processing and delivery times, tracking and address changes are explained in our Shipping Policy. If we cannot ship your order within the time stated there, or within 30 days after we receive your order if no time is stated, we will tell you before that deadline and you may cancel for a prompt full refund.

6.2. Delivery takes place when the carrier’s tracking shows the Products delivered to the shipping address you provided, including when they are left at your door or another place where the carrier ordinarily leaves parcels. The carrier’s delivery confirmation is proof of delivery, even without a signature, unless the Products were delivered to an address other than the one you provided. Title and risk of loss pass to you on delivery, except where mandatory law provides that risk passes only when you take physical possession.

6.3. Lost, damaged or incorrect deliveries are handled under our Refund Policy.

7. MONEY-BACK GUARANTEE, RETURNS AND REFUNDS

7.1. Your first order on the Website is covered by our 30-Day Money-Back Guarantee. If you are not satisfied for any reason, contact [email protected] within 30 days after delivery. We refund one opened bag of each Product without requiring its return, and any other bags from that order that you return unopened using the prepaid label we provide. The Guarantee applies once per customer and household and does not cover renewals, later orders or purchases from other sellers.

7.2. Unopened Products from other orders, including renewals, may be returned within 30 days after delivery, subject to the conditions and return shipping costs set out in our Refund Policy.

7.3. Our Refund Policy explains how to make a request, how refunds are paid and what to do if a Product arrives damaged, faulty or incorrect. These commitments are in addition to your rights under Section 8 and Section 12.

8. RIGHT OF WITHDRAWAL (EU, EEA AND UK CONSUMERS)

8.1. If you are a consumer residing in the European Union, the European Economic Area or the United Kingdom, you may withdraw from your contract within 14 days after you receive the Products (for a subscription, the first delivery) without giving a reason. It is enough to send a clear statement before the deadline. We refund all payments, including standard delivery costs, within 14 days, and you bear the direct cost of returning the Products. Our Refund Policy explains the procedure and includes a model withdrawal form.

8.2. The right of withdrawal does not apply to sealed Products whose protective seal you have broken after delivery, because they are not suitable for return for health protection and hygiene reasons. This does not affect the Money-Back Guarantee or your rights if a Product is faulty or does not conform to the contract.

9. AUTHORIZED SELLERS AND RESALE

9.1. We sell the Products through the Website and through retailers and marketplace sellers we have authorized in writing. Products bought from anyone else are subject to that seller’s terms, are not covered by our Money-Back Guarantee or Limited Warranty, and may have been stored or handled outside our quality controls.

9.2. In addition to Section 2.2, you must not, directly or through others:

(a) resell or commercially distribute Products through any channel, including Amazon, eBay, Walmart Marketplace, TikTok Shop, social media, websites, stores or wholesale;

(b) repackage, relabel, alter or tamper with Products, or remove or obscure their seals, labels or batch identifiers;

(c) use our brand, images or content in a way that suggests that we have authorized or endorsed you; or

(d) evade our fraud or anti-resale controls through false information, multiple accounts, intermediaries, forwarding services or automated tools.

9.3. If we reasonably believe that you have breached Section 2 or this Section 9 or attempted fraud, we may refuse or cancel orders (refunding any amount paid for orders not shipped), cancel subscriptions, suspend or close associated accounts, refuse promotional benefits or Guarantee claims connected with the breach, report the conduct to marketplaces and payment providers, and seek injunctions, damages, profits and legal fees where the law permits. We may verify orders, make test purchases and trace batch identifiers as described in our Privacy Policy. Unrelated breaches do not affect refunds or rights you are otherwise owed.

10. WEBSITE USE AND INTELLECTUAL PROPERTY

10.1. We grant you a limited, personal, non-exclusive and non-transferable license to use the Website for personal, non-commercial purposes. The Website’s content, branding and design are owned by us or our licensors, and no other rights are granted.

10.2. You must not use the Website unlawfully or fraudulently; impersonate others or create false or automated accounts; bypass its security or introduce malicious code; use bots or scraping tools, including for AI training, without our written permission; copy or commercially exploit its content; misuse promotions; or submit fraudulent orders, refund requests or payment disputes. Legitimate refund requests, payment disputes and honest reviews are never restricted.

10.3. We may restrict access or close an account where reasonably necessary to address a breach of these Terms, fraud or a security risk. You will still be able to cancel your subscription and receive any refund you are owed. Please keep your login details confidential.

10.4. We welcome honest reviews, positive or negative. Incentives for reviews are disclosed and never depend on a particular rating. We may remove reviews that are unlawful, abusive, discriminatory, unrelated to our Products, clearly false or that reveal another person’s private information, applying the same standards whatever the rating. By submitting a review, you grant us a non-exclusive, worldwide, royalty-free license to display and reproduce it on the Website and in our marketing without changing its meaning; we use your name or photo only with your consent. Nothing in these Terms restricts your right to publish honest reviews, including under the U.S. Consumer Review Fairness Act.

10.5. If you believe content on the Website infringes your copyright, email [email protected] (subject line “Copyright Complaint”) or write to our registered office, identifying the protected work, the material you believe infringes it and where it appears, your contact details and the basis of your complaint. We may remove infringing material and, in appropriate circumstances, close the accounts of repeat infringers.

11. PRIVACY AND COMMUNICATIONS

11.1. Our Privacy Policy explains how we collect, use and share personal information, your privacy rights and choices, and our use of cookies. Accepting these Terms does not replace any separate consent required by law.

11.2. We send emails about your orders, subscription and account even if you unsubscribe from marketing. We send marketing emails and text messages only where the law allows and, where required, with your separate consent, which is never a condition of purchase. You can unsubscribe at any time.

12. WARRANTIES AND LIABILITY

12.1. We warrant that each Product bought directly from us conforms to its label and is free from manufacturing defects until its “best by” date when stored and used as directed on the label (our “Limited Warranty”). It does not cover problems caused by improper storage or misuse. If a Product does not meet this Limited Warranty, we will, at your choice, replace it free of charge or refund the amount paid for it, including related taxes and delivery charges, as our Refund Policy explains. This Limited Warranty gives you specific legal rights, and you may also have other rights that vary by state or country.

12.2. We do not exclude any implied warranties or statutory guarantees that apply by law, including merchantability, fitness for a particular purpose and conformity with the contract. We give no other express warranty.

12.3. The Website and its general content are provided “as is” and “as available” to the extent permitted by law, and we do not guarantee uninterrupted or error-free access.

12.4. IF YOU ARE A CONSUMER IN THE UNITED STATES, AND SUBJECT TO SECTION 12.6, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM THESE TERMS, THE WEBSITE OR THE PRODUCTS, TO THE EXTENT PERMITTED BY LAW.

12.5. IF YOU ARE A CONSUMER IN THE UNITED STATES, AND SUBJECT TO SECTION 12.6, OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER, AND FOR CLAIMS RELATING ONLY TO USE OF THE WEBSITE, TO US$500, TO THE EXTENT PERMITTED BY LAW.

12.6. Nothing in these Terms limits liability for death or personal injury, for damage to property caused by a Product, for gross negligence, wilful misconduct or fraud, for our refund or replacement obligations, or for any other liability that the law does not allow us to limit.

13. ARBITRATION AND CLASS ACTION WAIVER (U.S. RESIDENTS)

THIS SECTION APPLIES ONLY IF YOU RESIDE IN THE UNITED STATES. IT REQUIRES INDIVIDUAL ARBITRATION AND WAIVES JURY TRIALS AND CLASS ACTIONS. YOU MAY OPT OUT WITHIN 30 DAYS UNDER SECTION 13.10.

13.1. EXCEPT AS PROVIDED IN SECTION 13.3, ANY DISPUTE ARISING FROM THESE TERMS, THE WEBSITE, THE PRODUCTS, YOUR PURCHASES OR OUR HANDLING OF YOUR PERSONAL INFORMATION WILL BE RESOLVED BY FINAL AND BINDING INDIVIDUAL ARBITRATION, AND YOU AND WE WAIVE THE RIGHT TO A COURT OR JURY TRIAL.

13.2. Before starting arbitration, the claiming party must send an individual written notice, signed by the claimant (and any lawyer), describing the dispute and the relief sought, with the claimant’s name, contact details and any order numbers. Notices to us go to [email protected] or our registered office (the “Notice Address”). For 30 days after receipt, both parties will try in good faith to resolve the dispute, and limitation periods are paused to the extent permitted by law. Completing this process is a condition to starting arbitration, but does not prevent small claims, urgent relief or a filing needed to preserve a deadline.

13.3. Either party may instead bring an individual claim in small claims court in your county or parish; seek court relief to protect intellectual property; bring court claims concerning Products bought primarily for commercial resale; or pursue claims or remedies that the law or Section 13.7 excludes from arbitration. A consumer’s claim is not excluded from arbitration merely because we allege a breach of the anti-resale provisions.

13.4. The American Arbitration Association (“AAA”) administers the arbitration under its Consumer Arbitration Rules and, where applicable, its Mass Arbitration Supplementary Rules (the “Rules”), available at adr.org. One neutral arbitrator decides each dispute in English and issues a written, reasoned award. Disputes are decided on written submissions where provided by the Rules. Any hearing will take place remotely by video or telephone, unless the arbitrator determines, on a party’s request, that an in-person hearing is necessary under applicable law or the Rules. Any required in-person hearing will take place in the county or parish where you reside, unless we both agree otherwise. If the AAA declines to administer the arbitration because we have not paid its fees or met its consumer standards, you may bring your claim in a court with jurisdiction. If the AAA is otherwise unavailable, the parties will agree on a comparable provider or a court with jurisdiction will appoint one.

13.5. Your filing fee is limited by the AAA’s fee schedule, and we pay the administration and arbitrator fees allocated to the business. We will seek our legal fees only if the arbitrator finds your claim frivolous or brought for an improper purpose and the law permits recovery.

13.6. A court decides whether this arbitration agreement was formed, whether you validly opted out, whether this delegation is enforceable and any dispute about Section 13.7. Otherwise, the arbitrator decides questions of scope, validity and enforceability.

13.7. YOU AND WE MAY BRING CLAIMS AGAINST EACH OTHER ONLY INDIVIDUALLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING, AND CLASS ARBITRATION IS NOT PERMITTED. Any non-waivable request for public injunctive relief may proceed in court, after or alongside the individual arbitration as the court decides. If a court finds this waiver unenforceable for a particular claim or remedy, only that claim or remedy proceeds in court.

13.8. Where the AAA applies its Mass Arbitration Supplementary Rules, each claimant must give the notice required by Section 13.2 and each claim remains individual.

13.9. We will email you at least 30 days before a material change to this Section 13. You may reject the change by notice to the Notice Address within 30 days after receiving our email, and the prior version will then continue to apply to you. No material change applies to a dispute that arose before it took effect.

13.10. You may opt out of this Section 13 within 30 days after you first accept these Terms by sending the Notice Address your name, postal and email addresses, any order number and a statement that you opt out of arbitration. If you validly opt out, neither you, nor Harmonia may enforce this Section 13 against the others, and Section 14 governs court proceedings. Opting out does not affect any other part of these Terms or your ability to buy from us.

13.11. These Terms involve interstate and foreign commerce, and the Federal Arbitration Act governs this Section 13. Any unenforceable provision is severed, subject to Section 13.7. If the arbitration agreement is unenforceable in its entirety, Section 14 governs court proceedings. Unless you opt out, this Section 13 survives cancellation, account closure and termination.

14. GOVERNING LAW AND COURTS

14.1. If you reside in the United States, the Federal Arbitration Act governs Section 13 and Delaware law, excluding its conflict-of-laws rules, governs the rest of these Terms, without limiting the mandatory consumer protections of your state. Subject to Section 13, court claims may be brought in the state or federal courts in New Castle County, Delaware, or the courts serving your county or parish, and you and we submit to their jurisdiction.

14.2. If you reside elsewhere, Lithuanian law and the Lithuanian courts apply, without limiting any mandatory consumer protection. Consumers residing in the EU, EEA or UK may also bring proceedings in the courts where they live, and we may bring proceedings against them only in the courts permitted by consumer jurisdiction rules. If you are a consumer residing in the EU and we have not resolved your complaint, you may refer it for out-of-court resolution to the State Consumer Rights Protection Authority of the Republic of Lithuania (Valstybinė vartotojų teisių apsaugos tarnyba), A. Goštauto g. 12, LT-01108 Vilnius, Lithuania, tel. +370 5 262 6760, https://vvtat.lrv.lt, or to another competent consumer dispute body in your country of residence.

15. GENERAL PROVISIONS

15.1. Entire agreement. These Terms, our Shipping Policy and Refund Policy, and your order confirmation form the entire agreement between you and us concerning your use of the Website and your purchases. This does not exclude any information or commitment that is binding on us under applicable law.

15.2. Events beyond our control. To the extent permitted by applicable law, we are not liable for delay or failure to perform caused by an event beyond our reasonable control whose effects we could not reasonably prevent or overcome. We will take reasonable steps to minimize its effects and notify you if it affects your order. Shipping delays are handled under Section 6.1. If we cannot ship a paid order within the applicable deadline, you may cancel it for a full refund. This provision does not affect your statutory rights or our refund obligations.

15.3. Transfers and service providers. You may not transfer your account or subscription to another person without our prior written consent, except where applicable law allows. To the extent permitted by applicable law, we may transfer our rights and obligations under these Terms, in whole or in part, without your further consent, to an Affiliate or to a successor following a merger, acquisition, reorganization or sale of the relevant business or assets. The recipient must assume the corresponding obligations, and the transfer must not reduce your rights or protections, including any entitlement to a refund or the Money-Back Guarantee. Using a payment collection agent or another service provider does not, by itself, change your seller or release us from our obligations. “Affiliate” means a company that controls, is controlled by, or is under common control with Harmonia Sciences, UAB.

15.4. Severability and waiver. If a provision is found invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. Section 13 contains specific rules for the arbitration agreement. A delay or failure by either party to enforce a right does not, by itself, waive that right.

15.5. Rights after termination. Ending these Terms, closing your account or cancelling your subscription does not affect rights or obligations relating to earlier purchases, including eligible returns, refunds and statutory remedies. Provisions intended by their nature to continue, including those concerning intellectual property, liability and dispute resolution, remain applicable. Section 13 remains subject to its opt-out and enforceability provisions.

15.6. Nothing in these Terms limits any right you have under consumer protection law that cannot be excluded or limited by contract.
